Terms and conditions for DipCatcher Pro

English translation for convenience. The German version is binding.

1. Provider and scope

These terms apply to every contract for the paid subscription “DipCatcher Pro” on dipcatcher.de. Contract languages are German and English.

2. Service

DipCatcher is an analysis tool. It evaluates public price data automatically and explains pullbacks, highs and trends. Pro unlocks the features described on the pricing page.

DipCatcher is an information service, not investment advice and not a broker. Signals are computed automatically from public price data and technical indicators. They can be wrong. Investments carry risk up to total loss. Decide for yourself and never invest money you cannot afford to lose.

3. Conclusion of contract

Pro requires an account. Under “Payment & billing” you see the service, price, term and renewal before ordering. Clicking “Order with obligation to pay” is a binding offer. We then forward you to our payment provider Mollie, where you can check, correct or cancel your details until the payment is completed. The contract is concluded once the first payment has been received and Pro is activated for your account. We do not store the contract text separately; you can view, save and print these terms here at any time. Invoices are in your account.

4. Price and payment

Pro costs €9.00 a month, paid monthly in advance. As a small business under § 19 UStG we do not charge VAT. Payment runs through Mollie with the methods offered there; renewals are charged at the start of each new month. A redeemed discount code applies to the first month only.

5. Term and cancellation

The contract runs for one month and renews for one more month at a time unless you cancel. You can cancel at any time to the end of the paid month: in your account under “Payment & billing”, without signing in via Cancel contracts here, or by e-mail to info@kawums.de. Pro stays active until the end of the paid month. The right to terminate for good cause is unaffected.

6. No refunds

Pro is paid monthly in advance. After a cancellation we refund neither unused days nor an unused month. Your statutory right of withdrawal (section 7) is unaffected.

7. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise it, inform us (Ingo Schildt · DipCatcher by KAWUMS, Ernststr. 1a, 56249 Herschbach, Germany, phone +49 151 72177448, e-mail info@kawums.de) by a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form in the German version, but you do not have to. You can also submit it electronically under Withdraw from contract; we will then confirm receipt by e-mail without delay. Sending the notice before the period ends is enough.

If you withdraw, we refund all payments received from you without delay and at the latest within fourteen days, using the same means of payment, free of charge. If you asked for the service to begin during the withdrawal period, you pay us an amount in proportion to what was provided until you informed us of the withdrawal. Your right of withdrawal expires once we have fully provided the service, if we only began after your express consent and your acknowledgement that you lose the right once the contract is fully performed (the checkbox before “Order with obligation to pay”).

8. Availability

We aim to keep DipCatcher available at all times. Maintenance and disruptions at data sources, hosting or network operators can cause interruptions. Prices may be delayed. We do not promise a specific availability.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breach of an essential contractual obligation, liability is limited to the typical, foreseeable damage. Otherwise we are not liable for slight negligence.

10. Changes to these terms

We tell you about changes to these terms or the price for running contracts by e-mail at least six weeks in advance. They only apply if you agree. If you do not agree, you can cancel to the end of the paid month.

11. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the country of their habitual residence. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board.
